Billing and Payments
As a subscriber, you agree to the following benefits and Terms: You must provide us and keep us up to date with accurate contact and payment information, including name, shipping address, and credit or debit card number. We save your payment information for ease of future shipments and charges. You are responsible for any fees or charges your issuing bank or credit card provider may charge you. If your payment to us is returned for any reason, we may bill your account again directly and seek payment by another method including a mailed statement. The Subscription Contract Between You And Us Live Whole Box offers two subscription types: rebillable or recurring monthly subscriptions (“Month-to-Month Subscriptions”) and prepaid or annual monthly subscriptions (“3, 6 and 12 Month Subscriptions”).
Recurring Subscriptions: Only the 1-month (Month-to-Month) subscription can be cancelled. The 3-, 6-, and 12-month subscriptions (whether monthly or prepaid) cannot be cancelled before its expiry date. By purchasing a Month-to-Month Subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive monthly periods, at the then-current subscription rate. To cancel your Month-to-Month Subscription at any time, you must email us. If you cancel, you may use your subscription until the end of your then-current subscription term. If a coupon or promo code was used to subscribe to a Month-to-Month subscription, and your subscription is canceled – by you or by Live Whole Box (refer to Termination section) – before your third box, you will be charged for the price difference of the coupon or promo code. Promo codes and coupons only apply to one month’s charge, unless otherwise explicitly stated – promo codes and coupons do not apply on an on-going basis or to more than one month’s charge. Live Whole Box may submit periodic charges (e.g., monthly) without further authorization from you, until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Live Whole Box reasonably could act.
Pre-paid Subscriptions: By purchasing a Pre-paid Subscription, you acknowledge that your subscription has an upfront pre-payment feature for the then-current term. At the end of the then-current term, your subscription will be automatically expire. You may not cancel your pre-paid subscription before it is set to expire.
Your Subscription Contract
By purchasing any subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive periods, at the then-current subscription rate. To cancel a Month-to-Month subscription, you must email us. Please note, 3-, 6-, and 12-month subscriptions (whether monthly or prepaid) cannot be refunded. If you cancel your Month-to-Month subscription, you will not be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.
Once your monthly box is shipped from us the box or products included cannot be returned. Unclaimed shipments may be returned back to us and can be shipped again to the customer once without extra costs. Any items that are received damaged or broken will be replaced with identical or similar items at no cost to the costumer, after photographs of the damage is emailed to us. Live Whole Box may credit your account in lieu of replacing damaged items. Replacements are at the sole discretion of LiveWholeBox.com.
Risk of Loss
Any merchandise purchased from Live Whole Box will be shipped by a third party carrier. As a result, title and risk of loss for such merchandise will pass to you upon our delivery to the carrier.
Product Accuracy and Limitation on Quantities
Excluding any content that may be submitted by Members from time to time, we strive to ensure that the information LiveWholeBox.com is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies, which we may correct without liability. We also reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted or acknowledged). We do not guarantee that all products described on our Site will be available.
We may terminate any user’s monthly subscription or access to our Site or Services, including access to any online discussion forum or chat room, in our sole discretion, for any reason and at any time, with or without prior notice. Examples of basis of termination are toxic customer interactions, and/or aggressive verbal or written customer communication, lying, stealing, or if Live Whole Box feels our product or services are not a good fit for the customer. It is our policy to terminate users who violate these terms and conditions, as deemed appropriate in our sole discretion. You agree that we are not liable to you or any third party for any termination of your access to our Site or Services.
When signing up as a customer or creating an order, the user becomes a customer. The given information will be registered in our database. The information will be used for development, production, contacting and other suitable uses. The information may also be used for our marketing and research purposes. The information will not be passed on to third parties.
We collect certain personal information from you, including but not limited to, your name, email address, shipping address, credit card information, and information from Third Party Services that you give us access to. We also collect certain non-personal information from you, such as the details of your visits to our Site, including but not limited to the type of browser and operating system you use, traffic data, location data, logs and other communication data and the resources that you access and use on the Site. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates. We never share your email.
How do you get my consent? When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. For example, when you subscribe to a Monthly Subscription, you consent to have your account charged on a monthly basis, until directed otherwise in writing. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. How do I withdraw my consent? If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at email@example.com.
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. Payment: If you choose a direct payment gateway to complete your purchase, then Stripe stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).
